Despite the successive scientific progress witnessed by humanity over time, the womb of scientific life—even to this day—continues to give birth to new innovations with features and qualities that did not exist before. Scientific life is still in a state of development, its features yet to be fully defined.
The technological and information revolution our world is experiencing, which has become the hallmark of this era, is the new offspring of this scientific evolution. After successfully creating machines to perform physical labor, humanity sought to build machines to alleviate mental burdens. These efforts culminated in the creation of the digital electronic computer. With growing efforts to develop it and integrate it into contract formation, a qualitative shift occurred in the methods used for contracting.
The development in information technology and the communications sector has had a profound and clear impact on the established principles of legal thought, especially the elements of evidence (writing and signature) which are based on a tangible, physical medium. This evolution has been accompanied by the emergence of multiple patterns and forms of means through which legal transactions are concluded. While these transactions were previously created through traditional (handwritten) writing and signed using a traditional signature on a physical medium, they are now created using modern technologies consisting of electronic writing and are signed electronically on a non-physical, intangible medium. The convergence of the trinity—the electronic computer, information technology, and the communications sector—which gave rise to the modern communication network, the "Internet," has contributed to the increased use of modern technologies in concluding legal transactions. This network has become humanity's window to the world, through which most activities and transactions are conducted remotely, without travel. It has broken the barriers of time and space, connecting the ends of the earth in mere seconds, sometimes in fractions of a second, which is known as e-commerce.
