This is the second work in the series on the codification of Islamic jurisprudence rulings. The series as a whole aims to affirm the adaptability of Islamic jurisprudence to modern formulation, ensuring its effectiveness in practical application under contemporary social conditions. This work gains its importance from its content, which relates to a highly vital topic in Islamic jurisprudence: the subject of Waqf (endowment). The concept of Waqf regained its standing after a fierce campaign led by several Orientalists in the mid-nineteenth century, which aimed to enable Western colonialism by facilitating the seizure of waqf lands. These lands were coveted for colonial investment, and the waqf system, from a legal and legislative perspective, prevented these territories—which constituted more than a third of the total land in some Islamic countries—from falling into the hands of these colonial investors.
