There is no doubt that the general theory of obligation is one of the most important and difficult topics in law. The author found that writing a book on this theory is an arduous and lengthy experience. Despite the constant apprehension to abandon the project, determination and resolve prevailed, and the idea for this book, which began five years ago, continued until it came to fruition. The driving motivation was always to create a book that would benefit professors and students of Jordanian civil law and other Arab legal systems.

In this work, the author places the provisions of the Jordanian Civil Code in the main text, reinforced by the latest rulings from the Jordanian Court of Cassation, which are included either in the text or in footnotes as needed. To enhance its utility, this study is designed to be comparative with several Arab laws—particularly those of Egypt, Lebanon, Kuwait, and the UAE—to highlight provisions that differ from the Jordanian Civil Code. These differences are noted in the footnotes throughout the book.

In this study on the sources of obligation, the author follows the structure adopted by the Jordanian legislator, dividing the subject into the following chapters after an introductory chapter defining obligation and its sources:

  • Chapter One: The Contract
  • Chapter Two: Unilateral Will
  • Chapter Three: Harmful Act (Tort)
  • Chapter Four: Beneficial Act (Unjust Enrichment)
  • Chapter Five: The Law
