The execution of a criminal penalty is the process of putting the criminal judgment that decreed the penalty into effect. Thus, the execution phase follows the trial phase. It is a crucial stage as it translates legal texts and judicial rulings into practical reality. Herein lies the gravity of this phase, as it is the arena where the purpose of the criminal penalty is realized. This undoubtedly requires the execution process to be subject to the principle of legality. Consequently, the legislator has addressed the issues related to execution through the 'dispute in execution' lawsuit.
Undoubtedly, this study is significant from both theoretical and practical perspectives. The legal library in Palestine is in dire need of such a study, and it can be said that this will be the first comprehensive study on the execution of criminal penalties in Palestinian legislation. The study also proves its practical importance as there are some errors that occur in the field, some due to misinterpretation of texts and others due to the lack of detailed regulation for the issues raised by execution.
