This study aims to guide theoretical study by linking it to practical and field reality, providing students in particular, and legal professionals in general, with the necessary information to follow from the initial filing of a civil lawsuit to the issuance of a judicial ruling, its subsequent appeal, and its execution.
This book covers the judicial organization of civil courts in the Hashemite Kingdom of Jordan and the judicial system. It discusses fundamental principles such as the independence, impartiality, and gratuity of the judiciary. It then addresses the formation of courts, followed by an examination of civil lawsuits and their conditions. It details the procedures prior to filing a lawsuit, the preparation of the case, its evidence and supporting documents, the submission of responsive pleadings, defenses, and objections, the cross-examination of witnesses, leading up to the final arguments and the issuance of a judgment, and the appeal of the judgment at the appellate and cassation levels.
In this book, we also address the enforcement of judgments and bonds in the enforcement department, the submission of execution requests, and applications for imprisonment, seizure, and execution against movable and immovable property, and the distribution of execution proceeds according to Jordanian Enforcement Law.
We then delve into the practical applications of civil lawsuits and their forms, including labor cases, financial claims, lease termination lawsuits, non-opposition cases, pre-emption claims, and electronic lawsuits.
For the purpose of increasing legal knowledge, we have included sample pleadings, petitions, defenses, and enforcement requests as submitted to the competent judicial bodies at all levels.
This study consists of an introductory chapter and two main sections. The introductory chapter discusses the basic principles of judicial organization. The first section covers the judicial procedures that a civil lawsuit goes through, and the second section deals with the practical applications of civil lawsuits and their forms.
