The shortcomings of the traditional theory of obligations in consumer protection, coupled with modern technological development, have led to the issuance of numerous laws and legislations for consumer protection. The recent technological evolution in communications and information, especially in the last few years, has contributed to the integration of electronic devices into the daily lives of individuals and companies alike. This has also affected the way commercial transactions and deals are conducted, both in terms of the initial agreement and the method of fulfilling the resulting legal obligations.

The emergence of e-commerce and its accompanying development, to the point where it is conducted over the internet, has significantly impacted the legal system of traditional contracts. This has led to the rise of what is known as cross-border electronic shopping and the subsequent procedures for establishing electronic contracts, in which the consumer is often a primary party.

Hence, the need for consumer protection in the electronic marketplace arose. Trust in the e-market is one of the most crucial elements for consumers to meet their personal needs. Legal protection for the consumer—whether in the pre-contractual stage, during the formation of the electronic contract, or during its execution—is critically important because the consumer can be the weaker party. In such cases, they may urgently need a specific product and consequently be subject to unusual and unfair conditions, with the selling company being the stronger party in this contract.
