Praise be to Allah, and peace and blessings be upon our master and beloved Muhammad, whom Allah made a shining lamp, a bearer of good tidings, and a warner to the worlds.
This humble book that we present to you is a simplified effort intended to serve the city of the beloved Prophet and its good people. In it, we discuss the Saudi penal system, which originates from Islamic Sharia—the message revealed to the Master of Messengers in the purest of lands—while also touching upon a brief comparison with Jordanian law and its applications.
We have addressed the general section of penal law through two main topics: "the crime" and "the criminal penalty," in a simplified yet detailed manner, using a concise and easy-to-understand style for our dear undergraduate students to cover public law material. This book is considered the first part of the general penal code, to be complemented by a second part on the special penal code, also known as the Saudi Penal System (Special Section). We have named it the Penal System, as this is the term used in the Kingdom, hoping and intending for it to benefit students of law and Islamic Sharia faculties, as this book is derived from documented and accredited legal and religious sources. It has been divided into four chapters: In the first chapter, we define penal law. In the second, we examine the elements of a crime. We then move to the third chapter to discuss criminal contribution, criminal liability, and grounds for justification. We conclude the fourth chapter with a brief overview of criminal penalties, which will be discussed in detail in the second book, the Special Penal Law, if Allah grants us long life.
We ask Allah Almighty to accept this work, done purely for His sake, and as a service and a mark in the city of the beloved Prophet, may Allah's peace and blessings be upon him.
